Having worked in the out of town retail market since 1987 Huw has provided advice on agency and development matters on a regular basis with regard to new and existing sites. Awareness of the activities of occupiers has proven fundamental to the approach adopted in addressing rental disputes at review or renewal and in the assessment of investment opportunities.
Huw has had much experience in the professional arena having worked on the earliest rent reviews in the out of town market in the late 1980s. This area of work has been a consistent part of his experience ever since with recent instructions undertaken on behalf of Greystones Trust, Harbert Asset Management, Threadneedle and Nuveen.
Huw’s involvement on professional matters has resulted in him acting as an Expert Witness in many disputes proceeding to Third Party (Arbitrator or Independent Expert) for resolution. For over 20 years he sat on the RICS President’s Panel for appointments to act as the Third Party settling rental disputes in the sector.
An absorbing and long running case recently considered the Interim Rent due on a substantial retail warehouse, vacated after more than 2 years holding over, which required Determination by an Independent Expert. A significant reduction of the tenant’s claim was secured.
Huw has provided advice and acted on investment matters (for both disposal and acquisition) throughout his years working in the sector for a range of institutional and occupational clients. This has included development funding, standing investment sales, sale and leasebacks as well as land sales with overage as a prelude to development. Most recently he acted on behalf of London Metric in respect of an acquisition of the Wickes store in Beverley.
The combination of the experience gained through nearly 40 years in the retail property market, and over 30 years in the out of town retail sector, provides a breadth of knowledge to be called on for many and varied instructions. Resolution of problems is a challenge enjoyed and these come to the fore frequently in seeking to maximise returns from and the prospects of asset management initiatives.
Recent instructions have included the appraisal of historic letting conditions in respect of vacant premises on behalf of Aviva and the resolution of aspects of defective title documentation throughout an investment acquisition.
